Welcome to YTHRAL. The website ythral.com (the "Site") and the brand YTHRAL are operated by YTHRAL. Throughout the Site, the terms "we", "us", and "our" refer to YTHRAL. By accessing or using our website, purchasing our products, or engaging with our services, you agree to be bound by the following Terms of Service, including all additional policies referenced herein or available by hyperlink. Please read these Terms carefully before using our services.

1. General conditions

By visiting our Site and/or purchasing products from us, you engage in our Service and agree to comply with and be bound by these Terms of Service. We reserve the right to refuse service to anyone for any reason at any time. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service without express written permission from us.

2. Eligibility and age of consent

By using this website, you represent and warrant that you are at least the age of majority in your country, state, province, or territory of residence, or that you are the age of majority and you have given us your consent to allow any of your minor dependents to use this Site.

3. Product information and availability

We strive to display the colors, details, and images of our garments as accurately as possible on our storefront. However, we cannot guarantee that your computer monitor or mobile screen's display of any color will be perfectly accurate.

All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this Site is void where prohibited.

4. Pricing, currency and payments

Currency: prices on ythral.com are set in United States Dollars (USD), and every checkout transaction is processed in USD. If a price is shown in your local currency, it is an estimate only.

Transaction fees: because payments are processed internationally, your bank or credit card issuer may charge a standard international or foreign transaction fee. YTHRAL is not responsible for these fees, which are set and charged only by your financial institution under your cardholder agreement.

Pricing corrections: prices for our products are subject to change without prior notice. We reserve the right to correct any pricing or typographical errors at any time, including after an order has been submitted.

5. Orders and cancellations

Order cancellation: you may request to cancel an order only if it has not yet been processed and shipped from our operations facility. Once an order has been handed over to our shipping carriers, it cannot be cancelled, and you must follow our standard return and exchange process. Order refusal: we reserve the right to refuse, limit, or cancel any order you place with us. This includes orders placed under the same customer account, the same credit card, and/or orders that use the same billing or shipping address. If we change or cancel an order, we will try to notify you using the email or billing phone number provided when the order was made.

6. Shipping and delivery

International shipping: YTHRAL ships worldwide, to every country available at checkout, with free shipping on every order. Express delivery in 3–5 business days is available at checkout, and every order is tracked. Delivery dates provided at checkout are good-faith estimates. We are not liable for shipping delays caused by carrier backlogs, customs inspections, severe weather, or other factors beyond our direct control.

Customs and duties: all orders are shipped under Delivered Duties Paid (DDP) terms. Any applicable import duties, customs charges, and clearance fees in your destination country are handled and paid by YTHRAL on your behalf. Your package arrives at your doorstep with no additional customs charges owed by you.

7. Returns, exchanges and refunds

All returns, exchanges, and refunds are governed by our Return and Refund Policy, which is part of these Terms.

Return window: you may request a return or size exchange within 14 days of delivery.

Return shipping: due to the cost of international reverse logistics, YTHRAL does not provide prepaid return shipping labels for standard size exchanges or change-of-mind returns. Customers are responsible for all return shipping costs involved in returning items to our designated returns address.

Returnless exchange: instead of high-cost return shipping, you may keep the original item and pay a flat shipping and handling fee of 15 USD to have a brand-new size or replacement shipped directly to your address.

Defective, damaged or incorrect goods: if a garment arrives defective, damaged, or incorrect, please inspect it right away and contact us at support@ythral.com within 5 days of delivery so we can review the issue and make it right. For verified cases, we do not require you to return the product. We will ship a replacement at no cost or issue a full refund.

Non-returnable items: custom or personalized pieces, items marked Final Sale or Clearance, and gift cards are not eligible for return, exchange, or store credit.

Statutory rights: nothing in this section limits or excludes your statutory rights under applicable consumer protection law. For UK customers, your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 are not affected. For Australian customers, our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

8. Intellectual property

All content included on this Site, including but not limited to brand logos, original garment designs, text, graphics, button icons, images, audio clips, digital downloads, data compilations, and software, is the exclusive intellectual property of YTHRAL and is protected by international copyright, trademark, and intellectual property laws. You may not copy, modify, distribute, or reproduce our designs or brand marks without express written consent.

9. User conduct and prohibited uses

In addition to other prohibitions set forth in these Terms of Service, you are prohibited from using the Site or its content:

  • For any unlawful purpose.
  • To solicit others to perform or participate in any unlawful acts.
  • To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances.
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others.
  • To upload or transmit viruses or any other type of malicious code.
  • To collect or track the personal information of others.
  • To spam, phish, pharm, pretext, spider, crawl, or scrape.

Any breach or violation of these terms will result in an immediate termination of your access to our Services.

Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot be excluded or limited under applicable law, including statutory consumer guarantees under the Australian Consumer Law and rights under the UK Consumer Rights Act 2015.

You agree to indemnify, defend, and hold harmless YTHRAL, our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

12. Governing law and jurisdiction

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India, without giving effect to any principles of conflicts of laws. Any disputes, claims, or controversies arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Surat, Gujarat, India.

Notwithstanding the above, if you are a consumer in the United Kingdom, the European Union, Australia, or Canada, nothing in this clause deprives you of the protection afforded by provisions that cannot be derogated from by agreement under the consumer protection laws of your country of residence. You may bring proceedings in the courts of your country of residence, and mandatory local consumer protection laws will apply where required.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
